TDG Communications, Inc. has created this privacy statement as a reflection of its commitment to privacy. The following statement discloses information gathering and dissemination practices for the information collected from adults and children 13 and over from www.digitaldeadwood.com.

I. Information Collection and Use

A. Information Collection
TDG Communications is the sole owner of the information collected on www.digitaldeadwood.com. TDG Communications collects information from our users upon registration and at various points within the Digital Deadwood user environment.

Registration
In order to fully access the features of Digital Deadwood, a user must first complete the registration form. During registration a user is required to give personally identifiable information such as a name, address, and email address. Your personal information is used by us to respond to your requests, to process your transactions, for administrative purposes, to process prizes, and to send you information about Digital Deadwood’s programs and advertising and/or promotional material from its marketing partners. We may also use your personal information for internal purposes, such as analyzing and managing the performance of www.digitaldeadwood.com. You may always opt-out of receiving future communications by visiting the site or responding to our permission-based e-mail (see the Opt-Out section below).

It is optional for the user to provide demographic information, such as family income and gender, but encouraged so we can provide a more personalized experience on our site.

Users can log on via a guest account without entering any demographic or personally identifiable information; however, many of the site’s features will not be available to guest users.

This information is collected for TDG Communication’s internal use, such as to enhance security, to detect demographic trends, to assist us in providing content tailored to your interests, and to otherwise enhance your experience while visiting Digital Deadwood. If you have given us permission during your registration, this information will also be shared with our marketing partners, who will send you information related to your interests and demographics.

Profile
We store information that we collect through cookies, log files, and/or third parties to create a profile of our users. A profile is stored information that we keep on visitors to Digital Deadwood that details their preferences. Consequently, collected information is tied to the user’s personally identifiable information to provide offers and improve the content of the site for the user. This profile is used to tailor a user’s visit to our Web site and to direct pertinent marketing promotions to them. If you have given us permission during registration, we will share your profile with our marketing partners. Your profile is shared together with your personally identifiable information.

Cookies
A cookie is a piece of data stored on the user’s computer tied to information about the user. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following your Internet browser’s help file directions.

Log Files
Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

II. Communications from the Site

Special Offers and Updates
We send all new users a welcoming email to verify username and password. Registered users will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.

Newsletter
If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address. Out of respect for our users privacy we provide a way to opt-out of these communications. Please see the Choice and Opt-out sections.

Service Announcements
On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance or we have made changes in our user agreement or privacy policy, we might send users an email. Users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.

Customer Service
We communicate with users to provide requested services related to their Digital Deadwood account. We reply via email or phone, in accordance with the user’s wishes.

III. Sharing

Legal Disclaimer
Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.

IV. Choice/Opt-out

Our users are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to our site during registration. However, users can always change their choice by accessing their account profile or by replying to newsletters and promotions with “unsubscribe” in the subject line.

VI. Surveys & Contests

Digital Deadwood may occasionally request information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and street address), and demographic information (such as postal code). Contact information will be used to notify the winners, award prizes, and assist with the marketing practices of the contest or survey sponsors. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. Users’ personally identifiable information will be shared with third parties, although we will always make this clear when we request this data. Though we may use an intermediary to conduct these surveys or contests, they may not use users’ personally identifiable information for any secondary purposes.

VII. Chatting and Public Forums

Please keep in mind that whenever you voluntarily disclose personal information online – such as on message boards, through e-mail, or in chat areas - that information can be collected and used by others. In short, by posting personal information online that is publicly accessible, you may receive unsolicited messages from other parties in return. TDG Communications and Digital Deadwood have no control over these unsolicited messages.

This Web site takes every precaution to protect our users’ information. When users submit sensitive information via the Web site, their information is protected both online and off-line

IX. Correcting/Updating/Deleting/Deactivating Personal Information

If a user’s personally identifiable information changes (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users’ personally identifiable information. This can usually be done by accessing your user profile or by emailing us at info@digitaldeadwood.com. Alternatively, you may contact us by telephone or postal mail using the information below.

X. Notification of Changes

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

If, however, we are going to use users’ personally identifiable information in a manner different from that stated at the time of collection we will notify users via email and by posting a notice on our Web site at least one month in advance

XI. PERSONAL INFORMATION COLLECTED FROM CHILDREN UNDER 13

As required under COPPA (the Children’s Online Privacy Protection Act), TDG Communications, Inc. will not collect more personally identifiable information from children under 13 than is necessary for them to participate on www.digitaldeadwood.com.

Children under 13 must enter information in all the required fields upon registration as any other user; however, TDG Communications, Inc. will not share any personally identifiable information with its business partners for marketing offers or targeted promotions. Information collected from users less than 13 years of age will only be used for demographic purposes and to send out service announcements as described above.

Before any personal information is collected from a child under 13, the child’s parent or guardian must give parental consent. TDG Communications, Inc. will accept consent in the form of a signed letter, which can be mailed or faxed to the address or number listed below. Information will not be collected from a child until TDG Communications, Inc. receives the signed letter via fax or mail. Therefore, children under 13 will be unable to create an account until this letter is received. These children can, however, use a guest account until such a letter is received by us.

Personal information obtained with verifiable parental consent for children under the age of 13 will be used to enable full access to Digital Deadwood and to send service information to your child about their account.

Parents may at any time request that we delete their child’s profile in whole or in part by contacting us using the information below. However, deletion of some information may limit the ability of the child to access certain features of Digital Deadwood.
